Artgraris is an independent illustration studio specializing in the creation of exclusive licensed artwork and Full Buyout artwork for logos, branding, packaging, apparel, merchandise, and digital media, with a primary focus on the cannabis and mushroom industries. Every artwork is originally created by our team of illustrators using signature strain art, engraving, and hand-drawn illustration techniques.
Through this Website, we offer a curated collection of original digital artwork, Custom Commission illustration services, a variety of artwork licensing options, and information about Artgraris’ creative services and activities. We are committed to delivering authentic, professional, distinctive, and high-quality artwork for individuals, businesses, and organizations worldwide.
Purpose of these Terms
These Terms of Use are established to define the rights, obligations, and responsibilities between Artgraris and every user of this Website.
These Terms govern the use of the Website, the purchase of digital products, custom illustration commissions, the use of artwork licenses, and all other services provided by Artgraris.
By establishing these Terms, we aim to ensure that every transaction and interaction is conducted in a transparent, secure, and mutually respectful manner.
Scope
Website, Services, Artwork, Digital Products, and Custom Commissions
These Terms of Use apply to all services made available through the Artgraris Website, including, but not limited to:
- Use of the Website and all content available on it
- Purchase of digital artwork
- Download of digital files
- Use of artwork licenses
- Purchase of an Exclusive License
- Purchase of a Full Buyout
- Custom Commission services
- Communication with the Artgraris team
- User account features and
- Any new services or products introduced in the future.
Where a particular service is subject to additional terms, policies, or agreements, those provisions shall form an integral part of these Terms of Use and shall govern the applicable service to the extent of any inconsistency.
Website Use
Acceptance of Terms
Agreement
By accessing, browsing, creating an account, making a purchase, downloading files, or otherwise using any services available through the Artgraris Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use and all applicable policies referenced herein.
If you do not agree with any part of these Terms, you must not access, use, or otherwise utilize the Artgraris Website or any of its services.
Binding Agreement
These Terms of Use constitute a legally binding agreement between you, as the User, and Artgraris, as the service provider.
Your continued access to or use of the Website constitutes your acceptance of and agreement to be legally bound by these Terms of Use.
If You Don’t Agree
Some services may be subject to additional policies or separate agreements that supplement these Terms of Use. Such policies and agreements may include, without limitation:

Eligibility
Minimum Age
By using the Artgraris Website, you represent and warrant that you have reached the minimum legal age required under the laws of your country or jurisdiction of residence to enter into a legally binding agreement.
If you have not reached the required legal age, you may use the Website only with the consent and supervision of your parent or legal guardian.
Legal Capacity
You represent and warrant that you possess the legal capacity to enter into transactions, execute legally binding agreements, and fulfill all obligations arising from your use of the Artgraris Services.
Business Customers
If you access or use the Artgraris Services on behalf of a company, organization, or other legal entity, you represent and warrant that you are duly authorized to act on behalf of, and to enter into legally binding agreements for, such entity.
All rights, obligations, and responsibilities arising from the use of the Artgraris Services shall be binding upon the entity that you represent.
Your Account
Creating an Account
Certain features and Services offered through the Artgraris Website require a User Account, including the purchase of Digital Artwork, License management, transaction history, and Digital File downloads.
When creating an Account, you must provide accurate, complete, and up-to-date information. You are solely responsible for all activities conducted through your Account.
Artgraris reserves the right to refuse any Account registration if the information provided is inaccurate, misleading, fraudulent, or otherwise inconsistent with these Terms of Use or applicable laws.
Account Security
You are responsible for maintaining the confidentiality of your email address, password, and all other Account login credentials. You must not share your Account access credentials with any third party.
If you become aware of any unauthorized access to or use of your Account, you must notify Artgraris immediately so that appropriate security measures can be taken.
Artgraris shall not be liable for any loss, damage, or unauthorized activity resulting from your failure to maintain the security of your Account.
Accurate Information
You agree to provide and maintain accurate, complete, and current Account information at all times.
If your name, email address, company information, or any other material information changes, you are expected to promptly update your Account details to ensure the proper delivery of communications and Services.
Multiple Accounts
Users may not create or maintain multiple Accounts for the purpose of abusing promotions, circumventing system restrictions, engaging in misleading transactions, or conducting any activity that may harm Artgraris or other Users.
Where such abuse is identified, Artgraris reserves the right to merge, restrict, suspend, or permanently terminate the related Accounts.
Account Suspension
Artgraris reserves the right to temporarily suspend access to a User Account where there is reasonable indication of:
- unlawful activities
- misuse of an Artwork License
- violations of these Terms of Use
- activities that threaten the security of the Website or other Users or
- suspected fraud or suspicious transactions.
During the suspension period, access to some or all Services may be restricted until the review process has been completed.
Account Termination
Artgraris reserves the right to terminate a User Account in the event of a material breach of these Terms of Use, misuse of Artwork, infringement of Intellectual Property Rights, or any other conduct that is detrimental to Artgraris.
Termination of an Account shall not release the User from any obligations or liabilities incurred prior to the effective date of such termination.
Acceptable Use
Permitted Uses
The Artgraris Website may be used for the following purposes:
- browsing the Artwork collection
- purchasing Artwork Licenses
- commissioning Custom Illustrations (Custom Commission)
- managing your User Account
- downloading purchased Digital Files
- learning about the Services offered by Artgraris and
- contacting our team.
All use of the Website must be lawful, reasonable, responsible, and in compliance with all applicable laws and regulations.
Fair Use
Users are expected to use the Website in a normal and reasonable manner and must not engage in any activity that interferes with the Services, places an unreasonable burden on the system, or negatively affects the experience of other Users.
Excessive automated use, system exploitation, or any activity intended to obtain an unauthorized or unfair advantage shall constitute a violation of these Terms of Use.
Website Availability
Artgraris endeavors to maintain the continuous availability of the Website. However, scheduled maintenance, system updates, technical issues, or circumstances beyond our reasonable control may result in temporary interruptions to the availability of the Services.
Artgraris reserves the right to perform maintenance, updates, or modifications to the Website without prior notice whenever such actions are necessary to preserve the security, stability, or quality of the Services.
Prohibited Uses
Illegal Activities
Users must not use the Website or any Artgraris Services for any unlawful purpose, to facilitate or support criminal activities, or to infringe upon the rights of any third party.
Copyright Infringement
Users must not copy, reproduce, distribute, publish, or resell any Artwork or other content owned by Artgraris without prior written authorization, except as expressly permitted under the applicable License.
Reverse Engineering
Users must not reverse engineer, decompile, modify, attempt to obtain any source files not provided, or otherwise seek unauthorized access to the internal components of any Artwork, product, or system.
Data Scraping
The use of bots, crawlers, scrapers, AI harvesting tools, or any other automated technologies to collect data, images, metadata, or Website content without the prior written consent of Artgraris is strictly prohibited.
Malware and Security
Users must not upload or transmit viruses, malware, ransomware, malicious code, or engage in any activity that may compromise the security, stability, or integrity of the Artgraris Website or its systems.
Fraudulent Activities
Any form of fraud, misuse of payment methods, use of false identities, manipulation of transactions, or activities intended to obtain an unlawful or unauthorized benefit shall constitute a violation of these Terms of Use.
Impersonation
Users must not impersonate any individual, company, or representative of Artgraris, nor provide any false or misleading information regarding their identity, authority, or affiliation.
Intellectual Property
Ownership of Artwork
All illustrations, designs, visual concepts, characters, compositions, typography, graphic elements, and all other creative works displayed or produced by Artgraris constitute Intellectual Property owned by Artgraris or by the respective creators who have lawfully granted Artgraris the rights to manage and license such works.
Unless expressly stated otherwise in a written Agreement, the purchase of any Artwork or the use of any Artgraris Services does not transfer ownership of the Copyright or any other Intellectual Property Rights to the Buyer.
The Buyer is granted only those rights expressly provided under the applicable License or as otherwise set forth in the relevant Agreement.
Copyright Protection
All works made available through the Artgraris Website are protected by applicable Copyright laws, Intellectual Property laws, and international treaties.
Such protection includes, without limitation:
- Illustrations
- Digital Artwork
- Designs
- Characters
- Visual Concepts
- Packaging Artwork
- Apparel Graphics
- Branding Assets and
- Visual Documentation.
Any unauthorized use may result in civil, criminal, or other legal remedies to the fullest extent permitted under applicable law.
Website Content
In addition to the Artwork, all content available on the Artgraris Website, including but not limited to text, logos, icons, photographs, videos, page layouts, supporting illustrations, user interfaces, documentation, and promotional materials, constitutes the Intellectual Property of Artgraris.
Such content may not be copied, modified, reproduced, republished, distributed, or used for any commercial purpose without the prior written consent of Artgraris.
Trademark
The name Artgraris, its logo, slogan, visual identity, and all other Brand Elements are trademarks or proprietary identifiers owned by or lawfully used by Artgraris.
Any unauthorized use of such Brand Elements, including any use that may create confusion or imply sponsorship, endorsement, affiliation, or any official relationship with Artgraris, is strictly prohibited without the prior written consent of Artgraris.
Reservation of Rights
All rights not expressly granted to the User under any License or written Agreement are expressly reserved by Artgraris.
Nothing contained in this Website or these Terms of Use shall be construed as transferring or assigning any Copyright, Trademark, Patent, or other Intellectual Property Rights unless such transfer is expressly stated in a written Agreement.
Products & Services
Products & Services Overview
Product Availability
All Artwork available on the Artgraris Website is offered subject to availability at the time of purchase. Artgraris reserves the right to add, update, discontinue, remove, or otherwise withdraw any Artwork from its catalog at any time without prior notice.
Artwork sold under an Exclusive License or Full Buyout arrangement may be permanently removed from sale in accordance with the applicable Licensing Policy.
Product Information
Each Product page may include relevant information, including but not limited to:
- Artwork Name
- Description
- Category
- License Type
- File Format
- Resolution or Technical Specifications
- Price and
- Other relevant information.
Artgraris makes reasonable efforts to ensure that all Product information is accurate and up to date. However, we do not warrant that Product descriptions are entirely free from typographical errors, inaccuracies, or delayed updates.
Pricing
All prices are displayed in the currency specified on the Website and are subject to change without prior notice. Any change in pricing shall not affect Orders that have been successfully completed before the revised price becomes effective.
Taxes
Displayed prices may not include applicable taxes, duties, customs charges, or other government-imposed fees required under the laws of the User’s country or jurisdiction.
The User is solely responsible for the payment of all applicable taxes, duties, and other governmental charges arising from the transaction in accordance with the laws of the applicable jurisdiction.
Order Confirmation
An Order shall be deemed accepted only after Artgraris has successfully verified the applicable payment and issued an Order Confirmation to the Buyer.
Artgraris reserves the right to reject, cancel, or suspend any Order where there is reasonable suspicion of pricing errors, violations of these Terms of Use, system abuse, fraudulent activity, or any other circumstance that may compromise the integrity of the transaction.
Digital Delivery
Digital Artwork will be made available for download or delivered using the method specified on the applicable Product page or as otherwise provided in the Digital Download & Delivery Policy.
The User is responsible for ensuring that the email address, User Account, or other designated delivery method is accurate, active, and accessible for receiving the purchased Digital Artwork.

What is Exclusive License
An Exclusive License is a premium License that grants a single Buyer the exclusive Commercial Use rights to a specific Artwork.
Upon completion of an Exclusive License transaction, the Artwork shall no longer be offered for sale or licensed to any other party for any commercial purpose.
The Exclusive License is intended for companies, Brands, and organizations requiring a unique and exclusive visual identity that will not be used by competing businesses.
For the avoidance of doubt, an Exclusive License does not constitute a transfer of Copyright or Intellectual Property Rights. All Copyright and Intellectual Property Rights in the Artwork shall remain exclusively owned by Artgraris unless expressly transferred pursuant to a Full Buyout Agreement.
Rights Granted
The holder of an Exclusive License is granted the exclusive right to use the Artwork within the scope of the applicable License.
Such rights include, without limitation, the use of the Artwork for:
- Branding and Visual Identity
- Product Packaging and Labels
- Apparel and Merchandise
- Websites, Applications, and Digital Media
- Social Media, Promotional Materials, and Marketing Campaigns and
- Printed or Digital Materials relating to the Buyer’s business operations.
For the duration of the Exclusive License, Artgraris shall not sell, license, or otherwise make the same Artwork available to any other commercial Buyer.
Restrictions
An Exclusive License grants exclusive rights of use only and does not transfer ownership of the Artwork or any Intellectual Property Rights associated with it.
The holder of an Exclusive License shall not:
- claim authorship or ownership of the Artwork
- resell the original Digital Files as standalone digital assets
- distribute any Source Files to third parties without the prior written consent of Artgraris
- sublicense, assign, or otherwise transfer the License without the prior written consent of Artgraris or
- register or claim Copyright ownership in the Artwork.
Any use beyond the scope of the applicable License shall constitute a breach of both the Exclusive License Agreement and these Terms of Use.
Ownership
An Exclusive License does not transfer ownership of the Copyright or any Intellectual Property Rights in the Artwork.
All Copyright, Moral Rights, and Intellectual Property Rights shall remain vested in Artgraris as the creator or lawful rights holder.
Artgraris reserves the right to display the Artwork as part of its:
- Studio Portfolio
- Case Studies
- Professional Publications
- Exhibitions
- Project Documentation and
- Promotional Materials.
Such display is solely intended to demonstrate Artgraris’ creative experience, portfolio, and quality of work and shall not grant any Commercial Use rights to any third party.
Where the Client requires confidentiality, such restrictions may be governed by a separate Non-Disclosure Agreement (NDA) or any other written Agreement executed by the Parties.
Full Buyout
Definition
A Full Buyout is an arrangement under which the Economic Rights in an Artwork are transferred from Artgraris to the Buyer in accordance with the terms of the Full Buyout Agreement.
Through a Full Buyout, the Buyer acquires broader rights to use, manage, adapt, and commercially exploit the Artwork as part of its business assets.
A Full Buyout represents the highest level of commercial rights offered by Artgraris.
Rights Transfer
Upon completion of a Full Buyout, the Economic Rights in the Artwork shall be transferred to the Buyer to the extent expressly specified in the Full Buyout Agreement.
Such rights may include, without limitation:
- unrestricted Commercial Use
- development of the Artwork as part of the Buyer’s Brand Identity
- modification, adaptation, and derivative development of the Artwork
- use of the Artwork across various media, platforms, and products and
- registration of Intellectual Property Rights where permitted under the applicable Agreement and governing law.
The scope of the transfer of rights shall be limited to and governed exclusively by the provisions expressly agreed upon by the Parties in the Full Buyout Agreement.
Ownership
Following the completion of a Full Buyout, the Economic Rights in the Artwork shall belong to the Buyer in accordance with the terms of the Full Buyout Agreement.
Artgraris shall no longer use, sell, license, or otherwise commercially exploit the Artwork.
The creator’s Moral Rights shall remain protected in accordance with applicable Copyright law and shall not diminish or otherwise affect the Economic Rights transferred to the Buyer.
Future Availability
Upon completion of a Full Buyout, the Artwork shall:
- No longer be available for sale
- No longer be marketed or distributed through the Website, online marketplaces, or any other distribution channels and
- No longer form part of the publicly available Artwork collection maintained by Artgraris.
Custom Commission
Custom Projects
The Custom Commission Service enables Clients to commission original illustrations specifically created to meet the requirements of a particular project, Brand Identity, or intended use.
Requests may be submitted through the Artgraris contact form, email, or other official communication channels by providing relevant project information, including the project description, visual references, intended use, timeline, and any applicable technical requirements.
The submission of a request shall not constitute a binding Agreement unless and until both Parties have mutually agreed in writing upon the scope of work, project fees, and applicable project terms.
Project Proposal
Before any work commences, Artgraris may prepare a Project Proposal, Quotation, or Scope of Work (SOW) setting out, among other things:
- Project Objectives
- Scope of Work
- Number of Illustrations
- Agreed Visual Style
- Project Timeline
- Number of Included Revisions
- Project Fees
- Payment Terms and
- Artwork Usage Rights.
Any Proposal or Quotation accepted by both Parties shall form the contractual basis for the execution of the Project.
Creative Process
Each Project may involve several creative stages, including:
- Creative Brief preparation
- Research and Concept Development
- Sketch Creation
- Illustration Development
- Design Refinement
- Final Approval and
- Preparation of Final Deliverables.
The creative process may vary depending on the complexity and specific requirements of each Project.
Client Responsibilities
The Client shall:
- provide complete and accurate Project information
- supply any supporting materials reasonably required
- provide approvals and feedback within a reasonable timeframe and
- ensure that all materials supplied to Artgraris do not infringe the rights of any third party.
Any delay in providing the required information or approvals may result in an extension of the Project schedule.
Revision Policy
The number of revisions included in the Project Fee shall be specified in the applicable Project Proposal or Project Agreement.
Revision requests that fall outside the agreed Scope of Work, including substantial changes to the approved concept after the design process has commenced, may be subject to additional fees and corresponding adjustments to the Project timeline.
Project Approval
The Artwork shall be deemed approved once the Client provides written final approval through the agreed communication channel.
Any subsequent changes requested after such approval may be treated as additional work outside the original Scope of Work.
Final Delivery
Upon full payment of all outstanding fees and completion of the Project, Artgraris shall deliver the Final Files in the formats agreed upon by the Parties.
Depending on the Project scope, deliverable formats may include AI, EPS, PSD, PDF, SVG, PNG, JPG, or any other formats specified in the applicable Project Proposal.
Ownership & License
Ownership of any Artwork created through the Custom Commission Service shall be governed by the applicable Project Agreement.
Unless expressly stated otherwise in writing, all Copyright and Intellectual Property Rights shall remain vested in Artgraris, while the Client shall receive only the usage rights granted under the applicable License.
A full transfer of rights shall take effect only where expressly provided in a Full Buyout Agreement or any other legally binding written Agreement of equivalent legal effect.
Payments & Refunds
Payments
Accepted Methods
Artgraris accepts the payment methods made available through the Website or as otherwise agreed upon in the applicable Project Proposal, including third-party payment services supporting both domestic and international transactions.
The list of available payment methods may be updated or modified from time to time in accordance with Artgraris’ operational requirements.
Payment Confirmation
A payment shall be deemed received only after it has been successfully verified by the applicable payment system or after the corresponding funds have been received by Artgraris.
Payment confirmation serves as the basis for processing an Order, activating a License, or commencing work on a Project.
Payment Schedule
For Custom Commission Services, payment may be made in full in advance or in installments, as specified in the applicable Project Proposal.
Where installment payments have been agreed upon, each payment milestone must be completed in accordance with the agreed payment schedule in order for the Project to proceed.
Taxes & Additional Fees
The User shall be solely responsible for all applicable taxes, duties, administrative charges, transaction fees, or other governmental or payment processing charges imposed under the laws of the User’s jurisdiction or by the applicable payment service provider.
Failed Payments
If a payment cannot be successfully processed, the applicable Order or Project shall not be processed until the payment has been successfully completed.
Artgraris reserves the right to cancel any transaction that cannot be verified within a reasonable period of time.
Chargebacks
If a User initiates a chargeback, payment dispute, or unilateral payment reversal without a valid legal basis, Artgraris reserves the right to suspend or terminate the applicable Services, restrict access to the User Account, or take any other action reasonably necessary to protect its legal rights and legitimate interests.
Refunds
General Policy
Refunds are governed by the Refund Policy, which forms an integral part of the official policies of Artgraris.
By purchasing any Product or using any Artgraris Services, the User acknowledges that they have read, understood, and agreed to the applicable Refund Policy.
Digital Products
As Digital Artwork becomes immediately accessible or downloadable following purchase, refunds for Digital Products shall be subject exclusively to the conditions set forth in the applicable Refund Policy
Each Original Artwork will be shipped using professional protective packaging and, where available, a shipping service that includes shipment tracking and transportation insurance appropriate to the value of the Artwork.
Commission Projects
Refunds relating to Custom Commission Services shall be determined based on the stage of Project completion, the work already performed, and the terms expressly agreed upon in the applicable Project Agreement between Artgraris and the Client.
Exceptions
In exceptional circumstances, Artgraris may, at its sole discretion and in good faith, consider an alternative resolution based on the specific facts of a particular case.
Any such resolution shall not establish a precedent or create any obligation for Artgraris to provide the same treatment in any other case.
Legal & Liabilities
Disclaimer
Information Accuracy
Artgraris makes reasonable efforts to ensure that all information made available on the Website is accurate, complete, and up to date. However, Artgraris does not warrant or guarantee that all information published on the Website will at all times be free from errors, inaccuracies, typographical mistakes, omissions, or delayed updates.
Website Availability
The Artgraris Website and Services are provided on an “as available” basis at the time of use. Technical issues, scheduled maintenance, system updates, or circumstances beyond the reasonable control of Artgraris may affect the availability of or access to the Website and its Services.
No Warranty
To the fullest extent permitted by applicable law, Artgraris makes no representations or warranties, whether express or implied, regarding the suitability of the Website, Services, or Artwork for any particular purpose, their uninterrupted availability, or any results that may be obtained from their use.
External Factors
Artgraris shall not be liable for any interruption, delay, or disruption caused by internet service providers, payment service providers, the User’s devices, third-party services, or any other circumstances beyond the reasonable control of Artgraris.
Limitation of Liability
Scope of Liability
Artgraris is responsible for providing its Services, Artwork, and information in accordance with the professional standards maintained by Artgraris. However, such responsibility is limited solely to the Services directly provided by Artgraris.
Artgraris shall not be liable for any loss or damage arising from the use of the Artwork or Services beyond their intended purpose, the scope of the applicable License, or the terms expressly agreed upon by the Parties.
Indirect Damages
To the fullest extent permitted by applicable law, Artgraris shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business opportunities, loss of data, business interruption, or any other consequential losses arising out of or relating to the use of the Website, Artwork, or Services.
User Decisions
Any decision made by the User based on the Artwork, information, or Services provided by Artgraris shall be made at the User’s own discretion and risk.
The User is solely responsible for ensuring that the use of the Artwork complies with the requirements of the applicable Project, the terms of the applicable License, and all laws and regulations in the User’s jurisdiction.
Maximum Liability
If, notwithstanding any provision of these Terms of Use, Artgraris is held liable for any claim under applicable law, the total aggregate liability of Artgraris shall, to the fullest extent permitted by applicable law, not exceed the total amount actually received by Artgraris for the Product or Service giving rise to the claim.
Indemnification
User Responsibility
